Online services Terms of Use
In these Terms of Use (Terms), we refer to WorkSafe New Zealand as “WorkSafe”, “we” or “us”.
These Terms apply to the WorkSafe’s online service (Online services) and to any feedback, documents or submissions provided through Online services. These Terms must be read in conjunction with the WorkSafe Website ‘About this Site’ subsections. By creating an account, or by viewing and using Online services you will be deemed to agree to these Terms.
From time to time we may need to update these Terms to reflect how Online services operates. Where we do so, we will notify you of any change that is material or that is to your detriment before the changes take effect (unless the changes are required by law). If you continue to use Online services once the Terms have been updated, you will be deemed to be bound by the revised Terms.
About Online services
Online services is a digital channel that enables users to access some of WorkSafe’s services and engage with WorkSafe online. Users will be able to undertake a range of activities including:
- create and manage their account
- making applications/notifications
- communicating with WorkSafe
- receiving information and educational material.
User Conduct
The following terms apply to your conduct when accessing or using Online services.
You agree to:
- submit information that is true, correct, relevant and in good faith
- maintain the accuracy of your information. You can update your information by signing in to your account via Online services
- provide timely responses to communications from WorkSafe, including requests for more information to support your online interactions
- treat your user login and password confidentially.
You agree not to:
- interfere with or disrupt Online services’s operational, security or other systems
- use for Online services other than for its intended use
- access or use Online services for any purpose that is unlawful or prohibited by these Terms
- obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through Online services
- reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, any portion of Online services
- impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity
- interfere with any other user’s right to privacy, including by harvesting or collecting personal information about users of Online services or posting or sharing personal information about a third party, unless you have their written consent.
You are responsible and liable for the consequences of all use of Online services through your account.
Continuity of Service
We make no warranty or representation, express or implied, as to continuity of service. We reserve the right to change, suspend, disconnect, remove, terminate or otherwise alter to some or all of Online services’s content and services at any time and without notice. This may occur:
- during any technical failure, modification or maintenance involving Online services
- if you fail to comply with these Terms or any other agreement you have with us
- at WorkSafe’s sole discretion, including where we have found that the details supplied by you are inaccurate or misrepresentative of you
- if you do, or allow to be done, anything which in our opinion may have the effect of:
- Jeopardising the operation of Online services or
- Breaching these Terms.
Collection and Use of Information
By using Online services, you agree that we can use your personal information as set out in the Online services Privacy Statement and Website Privacy Policy and Statement.

Cookies
We may collect general information such as the pages you access, the date and time of your visit, IP address, and the domain name and country from which you access Online services. This includes the use of "cookies". Most browsers can be configured so as not to accept cookies. However, this may affect the functionality of Online services.
Transmitting Information
You should be aware that there are risks in transmitting information across the Internet and no data transmission can be guaranteed as totally secure. While we take steps to ensure the security of information that you transmit*, transmission of information online is at your own risk. If you are concerned about conveying information to us over the Internet, you might prefer to access WorkSafe’s services offline, including by sending information via mail to the following address:

Pricing
All prices stated are in New Zealand dollars and include Goods and Services Tax (GST). The GST amount will be shown separately to the product price on the GST receipt produced by WorkSafe.
Where applicable, cost for delivery will be charged separately. You will be notified of this fee.
Payment
Applications will not be processed until payment has been received by WorkSafe.
Upon successful payment, you will receive a confirmation of your payment by email.
All card payment transactions will take place within a secure payment system provided by Windcave. Windcave is solely responsible for these transactions. Please refer to the Windcave Privacy Policy for more information.
General
WorkSafe does not accept liability for any failure to comply with these Terms where such a failure is due to circumstances beyond its reasonable control. If WorkSafe waives any rights available to it under these Terms on one occasion, this does not mean that those rights will automatically be waived on any other occasion. If any of these Terms are held to be invalid, unenforceable, or illegal for any reason, the remaining Terms shall nevertheless continue in full force.
Governing Law
You agree that these Terms are governed, interpreted and enforced by the laws of New Zealand and by using Online services, you submit to the non-exclusive jurisdiction of the Courts of New Zealand.
